Muzyc's Bounce House & Party Rental - Terms and Conditions of Sale

1. GENERAL TERMS

All inflatable products, accessories, and related items sold by Muzyc's BHPR ("Seller") are subject to the following Terms and Conditions of Sale ("Terms"). By placing an order, the purchaser ("Buyer") agrees to be legally bound by these Terms. No representative, agent, or employee of the Seller is authorized to modify, waive, or alter any provision of these Terms unless expressly agreed to in writing and signed by an authorized officer of Muzyc's BHPR.

2. ORDER POLICY

  • 2.1 All products are sold on a first-come, first-served basis. Availability is not guaranteed until payment or deposit is received.

  • 2.2 For in-stock items, orders must be paid in full and are subject to immediate shipment unless a different arrangement has been agreed upon in writing by Seller.

  • 2.3 A non-refundable deposit of thirty percent (30%) is required to reserve production space for standard orders. A deposit of fifty percent (50%) is required for custom or made-to-order products.

  • 2.4 Orders without a deposit will not be scheduled for production. Production timelines and estimated ship dates begin only after the required deposit has been received.

3. CANCELLATION POLICY

  • 3.1 Orders may be cancelled within forty-eight (48) hours of placement or prior to shipment, whichever comes first, by providing written notice to the Seller.

  • 3.2 Cancellations of standard items made after the forty-eight (48) hour window, but before shipment, are subject to a restocking fee equal to thirty percent (30%) of the total purchase price.

  • 3.3 Once an order has shipped, it is no longer eligible for cancellation, refund, or credit. The Seller does not cover or refund any shipping costs for cancelled or refused shipments.

  • 3.4 All custom orders are final, non-cancellable, and non-refundable. Deposits made on custom orders will be forfeited if the order is cancelled at any time.

4. PAYMENT TERMS

  • 4.1 The final balance must be paid in full no later than forty-eight (48) hours prior to the scheduled shipment date.

  • 4.2 Accepted payment methods include Zelle, wire transfer, cash, or an approved credit card. All payments must clear before shipment is released.

  • 4.3 Muzyc's BHPR reserves the right to withhold or delay production and/or shipment if payment obligations are not fulfilled in full and on time.

  • 4.4 The Buyer is solely responsible for tracking payment deadlines. The Seller is under no obligation to send reminders or notices regarding upcoming payment due dates.

5. SHIPPING & DELIVERY

  • 5.1 All shipments are made F.O.B. Katy, Texas. Title and risk of loss transfer to the Buyer upon delivery to the carrier.

  • 5.2 Shipping dates provided by Muzyc's BHPR are estimates only and are not guaranteed. Muzyc's BHPR is not liable for any delays caused by freight carriers, weather conditions, labor strikes, government actions, or acts of God.

  • 5.3 The Buyer may request a preferred freight carrier. If no carrier is specified, Muzyc's BHPR will select one at its sole discretion.

  • 5.4 The Buyer must inspect all goods immediately upon delivery. Any claims for shortages, damage, or defects must be submitted in writing to Muzyc's BHPR within five (5) calendar days of delivery.

  • 5.5 All risk of loss during transit is the responsibility of the Buyer. It is the Buyer’s responsibility to obtain shipping insurance if desired.

  • 5.6 Muzyc's BHPR does not cover or reimburse any shipping costs related to delays, returns, refunds, or warranty claims. All such costs are the sole responsibility of the Buyer.

6. INSPECTION & ACCEPTANCE

  • 6.1 The Buyer must inspect all goods immediately upon receipt. Any claims for visible defects, shortages, or non-conforming products must be submitted to the Seller in writing within five (5) calendar days of delivery.

  • 6.2 Failure to notify the Seller in writing within the specified inspection period will constitute a waiver of any such claims and will be deemed full acceptance of the goods in their delivered condition.

  • 6.3 If any damage occurs during transit, the Buyer must document the damage at the time of delivery with the freight carrier. Visible damage must be noted on the shipping receipt before the driver leaves. Photos are strongly recommended.

7. WARRANTY

  • 7.1 Muzyc's BHPR (Party & Equipment Rentals) provides all bounce houses, water slides, and party equipment in clean, safe, and working condition at the time of delivery. Because all items are rented for short-term use (one day up to a maximum of seven days), no long-term warranty applies.

  • 7.2 The Renter acknowledges that normal wear and tear, minor cosmetic imperfections (including fading or color variations), and signs of regular use may be present and do not affect the safe operation of the equipment.

  • 7.3 The Renter is responsible for proper use, supervision, and care of all rented equipment during the rental period. Any damage resulting from misuse, improper setup, unauthorized modifications, or failure to follow provided safety guidelines will be the responsibility of the Renter.

  • 7.4 If any equipment issue arises during the rental period, the Renter must notify Muzyc's BHPR immediately. We will make reasonable efforts to repair, replace, or adjust the equipment as availability allows; however, replacement units are not guaranteed.

  • 7.5 Muzyc's BHPR is not liable for interruptions, delays, weather-related issues, power loss, or other circumstances that may impact the use of the rented equipment, including any loss of business, event disruption, or indirect damages.

  • 7.6 Blowers and any third-party equipment included with rentals are maintained to working condition but are not covered under any separate warranty during the rental period. No additional warranties, expressed or implied, are provided beyond ensuring the equipment is operational at delivery.

8. LIMITATION OF LIABILITY

  • 8.1 Muzyc's BHPR is not liable for special, incidental, or consequential damages including lost income or business interruption.

  • 8.2 Muzyc's BHPR’s maximum liability shall not exceed the product’s purchase price.

9. TAXES AND DUTIES

  • The Buyer is responsible for all applicable sales taxes, fees, and duties related to their purchase. Muzyc's BHPR only ships within the United States.

10. INTELLECTUAL PROPERTY

  • All logos, designs, images, and marketing materials are the sole property of Muzyc's BHPR. Unauthorized use is strictly prohibited.

11. INDEMNIFICATION

  • The Buyer agrees to indemnify and hold harmless Muzyc's BHPR from any claims arising from the use, misuse, or resale of the products.

12. INSURANCE REQUIREMENT

  • The Buyer must maintain general liability insurance of at least $1,000,000 per occurrence covering all products purchased.

13. RETURN POLICY

  • 13.1 All sales are final. No returns or exchanges unless the item is damaged at the time of purchase.

  • 13.2 Damage must be reported within five (5) days of delivery.

  • 13.3 All cancellations are subject to a 30% restocking fee. Custom orders are non-refundable.

14. FORCE MAJEURE

  • Muzyc's BHPR is not liable for delays or failures caused by unforeseen events beyond its control, such as natural disasters, labor strikes, or government actions.

15. GOVERNING LAW & VENUE

  • This agreement is governed by Texas law. All disputes must be resolved in Fort Bend County, Texas.

16. LEGAL FEES

  • The prevailing party in any legal action is entitled to recover attorneys’ fees and legal costs.

17. SEVERABILITY

  • If any provision is found unenforceable, the remaining sections will still apply in full force.

18. ENTIRE AGREEMENT

  • These Terms constitute the full agreement between Muzyc's BHPR and the Buyer, superseding all prior communications.

19. RIGHT TO REFUSE SERVICE

  • Muzyc's BHPR reserves the right to refuse service or cancel orders at its discretion without liability.
